The lawsuit claims that Pfizer and Ranbaxy unlawfully kept generic versions of Lipitor off the market, so consumers and third-party payors paid more for brand and generic Lipitor than they should have. Pfizer and Ranbaxy deny they did anything wrong. There has been a settlement with Pfizer; the lawsuit against Ranbaxy is ongoing. No one is claiming that Lipitor is unsafe.<\/p>\n<p><b>Who is included in the Settlement?<\/b>\u00a0You may be included in the Settlement if you purchased, paid, and\/or provided reimbursement for branded Lipitor or generic atorvastatin calcium and fall within any <i>one<\/i> of the following definitions:<\/p>\n<p><b>Third-Party Payor Class (&#8220;TPP Class&#8221;) <\/b><\/p>\n<p>All entities that, for consumption by their members, employees, insureds, participants, or beneficiaries, purchased, paid, and\/or provided reimbursement for some or all of the purchase price of branded Lipitor or generic atorvastatin calcium, in <span class=\"xn-location\">Arizona<\/span>, <span class=\"xn-location\">California<\/span>, <span class=\"xn-location\">Washington, D.C.<\/span>, <span class=\"xn-location\">Florida<\/span>, <span class=\"xn-location\">Iowa<\/span>, <span class=\"xn-location\">Kansas<\/span>, <span class=\"xn-location\">Maine<\/span>, <span class=\"xn-location\">Maryland<\/span>, <span class=\"xn-location\">Massachusetts<\/span>, <span class=\"xn-location\">Michigan<\/span>, <span class=\"xn-location\">Minnesota<\/span>, <span class=\"xn-location\">Mississippi<\/span>, <span class=\"xn-location\">Montana<\/span>, <span class=\"xn-location\">Nebraska<\/span>, <span class=\"xn-location\">Nevada<\/span>, <span class=\"xn-location\">New Hampshire<\/span>, <span class=\"xn-location\">New Mexico<\/span>, <span class=\"xn-location\">New York<\/span>, <span class=\"xn-location\">North Carolina<\/span>, <span class=\"xn-location\">North Dakota<\/span>, <span class=\"xn-location\">Oregon<\/span>, <span class=\"xn-location\">South Dakota<\/span>, <span class=\"xn-location\">Tennessee<\/span>, <span class=\"xn-location\">West Virginia<\/span>, or <span class=\"xn-location\">Wisconsin<\/span> (the &#8220;Class States&#8221;), other than for resale, at any time during the period from <span class=\"xn-chron\">June 28, 2011<\/span> through and until <span class=\"xn-chron\">December 31, 2012<\/span>.<\/p>\n<p><b>Consumer Class <\/b><\/p>\n<p>All individuals who purchased, paid, and\/or provided reimbursement for some or all of the purchase price of branded Lipitor, in the Class States, without the use of a Pfizer co-pay card, from <span class=\"xn-chron\">June 28, 2011<\/span> through <span class=\"xn-chron\">November 29, 2011<\/span>.<\/p>\n<p>All individuals who purchased, paid, and\/or provided reimbursement for some or all of the purchase price of generic atorvastatin calcium, in the Class States, from <span class=\"xn-chron\">November 30, 2011<\/span> through <span class=\"xn-chron\">December 31, 2012<\/span>.<\/p>\n<p>A more detailed notice, including the full class definitions, and who is not included, is available at <a href=\"http:\/\/www.LipitorAntitrustSettlement.com\" rel=\"nofollow\">www.LipitorAntitrustSettlement.com<\/a>.<\/p>\n<p><b>What does the Settlement provide?<\/b>\u00a0Pfizer will pay <span class=\"xn-money\">$35 million<\/span> into a Settlement Fund that will pay (1) money to eligible Class Members; (2) notice and administration costs; (3) service awards to the class representatives who brought the lawsuit; and (4) attorneys&#8217; fees, costs, and expenses.
