The lawsuit names Vistra Corp., PG&amp;E and others as defendants alleging that their lithium-ion battery storage system released hazardous toxins into the environment and contaminated the surrounding communities.<\/p>\n<div id=\"prni_dvprnejpg116aleft\" dir=\"ltr\" style=\"width: 100%; text-align: left;\"><img decoding=\"async\" id=\"prnejpg116aleft\" title=\"LOGO\" src=\"https:\/\/mma.prnewswire.com\/media\/2643422\/Danko_Meredith.jpg\" alt=\"LOGO\" align=\"middle\"\/><\/div>\n<p>The lawsuit asks that Defendants be permanently barred from using NMC batteries at the facility, that defendants be required to remediate the environmental contamination, and that plaintiffs exposed to the contamination be compensated for the costs of lifetime medical monitoring.<\/p>\n<p><b>Impact on <span class=\"xn-person\">Brian Roeder<\/span> and His Community<\/b><\/p>\n<p><span class=\"xn-person\">Brian and Angie Roeder<\/span>, along with their young son, had recently completed renovations on what they hoped would be their forever home in <span class=\"xn-location\">Prunedale<\/span>. Since the fire, they have been living in short-term rentals without knowing when it will be safe to return.<\/p>\n<p>The fire has caused Angie, a U.S. Air Force veteran, persistent respiratory distress. It has caused Brian, a local businessman, daily headaches and breathing difficulties. Brian co-founded <i>Never Again Moss Landing<\/i>; a grassroots organization committed to preventing similar disasters.<\/p>\n<p>Brian initiated and funded a large-scale citizen-led surface sampling initiative. Analysis of these samples revealed elevated concentrations of heavy metals, including nickel, cobalt, manganese, and lithium, in regions downwind of the facility. The results, which align with findings from <span class=\"xn-org\">San Jose State University&#8217;s<\/span> Elkhorn Slough study, show widespread heavy metal contamination across <span class=\"xn-location\">Santa Cruz<\/span>, <span class=\"xn-location\">Monterey<\/span>, and <span class=\"xn-location\">San Benito<\/span> counties.<\/p>\n<p><b>The Complaint: Holding Responsible Parties Accountable<br \/><\/b>The lawsuit alleges that Vistra Corp. and its affiliates, along with battery manufacturer LG Energy Solution and utility provider PG&amp;E, bear responsibility for the disaster.
