Thriving Mind denies any wrongdoing. Thriving Mind has not been found liable of anything by any court.<\/p>\n<p><b>Who is a Settlement Class Member?<br \/><\/b>You\u00a0are\u00a0affected\u00a0by\u00a0the\u00a0Settlement\u00a0and\u00a0potentially a\u00a0Settlement Class Member if\u00a0you are a living individual residing in <span class=\"xn-location\">the United States<\/span> who were sent a notice by Thriving Mind that their Private Information may have been impacted in the Data Incident, between <span class=\"xn-chron\">August 1, 2023<\/span>, and <span class=\"xn-chron\">August 3, 2023<\/span>.<\/p>\n<p><b>What does the Settlement provide?<br \/><\/b>Settlement Class Members under the Settlement Agreement will be eligible to receive:<\/p>\n<p class=\"prnml40\">1.<b>Cash Payment A \u2013 Documented Losses: <\/b>Settlement Class Members may submit a Claim for a Cash Payment for up to <b><span class=\"xn-money\">$5,000<\/span><\/b> per Settlement Class Member that includes reasonable documentation supporting the losses related to the Data Incident, upon submission of a Valid Claim and supporting documentation, for unreimbursed ordinary and\/or extraordinary economic losses incurred as a result of the Data Incident; <b>OR<\/p>\n<p><\/b>2.<b>Cash Payment B \u2013 Flat Cash:\u00a0<\/b>As an alternative to Cash Payment A \u2013 Documented Losses above, a Settlement Class Member may elect to receive Cash Payment B \u2013 Flat Cash, which is a flat Cash Payment in an estimated amount of <b><span class=\"xn-money\">$100<\/span><\/b>.<\/p>\n<p>In addition to a Cash Payment, Settlement Class Members may select the following:<\/p>\n<p class=\"prnml40\">3.<b>Credit\/Data Monitoring \u2013\u00a0<\/b>Settlement Class Members may elect up to one (1) year of Credit Monitoring with three credit bureaus. Credit Monitoring has a value of <span class=\"xn-money\">$90<\/span> per year per Settlement Class Member.<\/p>\n<p>All Settlement Class Cash Payments will be subject to a pro rata increase in the event the amount of Valid Claims is insufficient to exhaust the entire Settlement Fund. Similarly, in the event the amount of Valid Claims exhausts the amount of the Settlement Fund, the amount of the Cash Payments will be reduced pro rata accordingly. Any pro rata increases or decreases to Cash Payments will be on an equal percentage basis.<\/p>\n<p><b>What are your Rights and Options?<\/b><\/p>\n<ul type=\"disc\">\n<li><b>Do Nothing<\/b>: If you do nothing, you will not receive any benefits from this Settlement. If the Settlement is granted Final Approval and becomes final, you will not be able to start a lawsuit, continue with a lawsuit, or be part of any other lawsuit against Defendant or the other Released Parties based on any claim that could have been or that was brought relating to the Data Incident.<\/li>\n<li><b>Submit a Claim Form:<\/b> To receive a Settlement Class Member Benefit, you must complete and submit a Claim Form online or by mail, along with any supporting documentation. Claim Forms must be submitted or postmarked on or before <b><span class=\"xn-chron\">July 14, 2025<\/span><\/b>.<\/li>\n<li><b>Exclude Yourself by Opting Out of the Class<\/b>: Receive no benefit from the Settlement. This is the only option that allows you to keep your right to bring any other lawsuit against Defendant relating to the Data Incident.
