The proposed policy could have a significant negative impact on the states middle class economy. The aerospace industry is a major source of jobs and federal contracts in <span class=\"xn-location\">Florida<\/span> but that could change if the new NASA policy is adopted.<\/p>\n<p>Logo &#8211; <a href=\"http:\/\/photos.prnewswire.com\/prnh\/20160815\/398367LOGO\" target=\"_blank\" rel=\"nofollow\">http:\/\/photos.prnewswire.com\/prnh\/20160815\/398367LOGO<\/a> <\/p>\n<p>One of the nation&#8217;s leading experts on federal contracting law, <a href=\"http:\/\/law.ubalt.edu\/faculty\/profiles\/tiefer.cfm\" target=\"_blank\" rel=\"nofollow\">Professor Charles Tiefer<\/a> has issued an <a href=\"http:\/\/www.asbl.com\/documents\/Tiefer_Opinion_GSA_FSSI.pdf\" target=\"_blank\" rel=\"nofollow\">ominous legal opinion<\/a> on the proposed NASA Federal Strategic Sourcing Initiative policy. Professor Tiefer served as a Commissioner on the Congressionally chartered, independent Commission on Wartime Contracting in <span class=\"xn-location\">Iraq<\/span> and <span class=\"xn-location\">Afghanistan<\/span>.<\/p>\n<p>The title of Tiefer&#8217;s legal opinion is, &#8220;Proposed Regulations Illegally Authorize &#8216;Strategic Sourcing&#8221; to Massively Reduce the Breadth of Contracting with Small Businesses&#8221;. <\/p>\n<p>The legal opinion on the proposed NASA policy states, &#8220;The proposed regulations would reduce the breadth of small business contracting by up to 80% or even 90% in lines of business where small business contracting is currently common. This proposal is blatant and undeniably illegal; indeed, the proposal impliedly admits the key facts underlying the illegality&#8221;.<\/p>\n<p>In his Conclusion Professor Tiefer states, &#8220;The proposal should be junked. It would have an overwhelming bad impact on the breadth of small business contracting, contrary to the intent of the small business laws&#8221;. <\/p>\n<p>If adopted, the NASA policy could force thousands of <span class=\"xn-location\">Florida<\/span> small business out of the federal marketplace and possibly out of business. The dramatic reduction in the volume of federal contracting dollars flowing to <span class=\"xn-location\">Florida<\/span> small businesses could cost the state millions of jobs.<\/p>\n<p>The American Small Business League (<a href=\"http:\/\/www.asbl.com\/\" target=\"_blank\" rel=\"nofollow\">ASBL<\/a>) has launched a national campaign to oppose the policy proposed by NASA, the Pentagon and the General Services Administration (GSA). <\/p>\n<p>In 2007 the <a href=\"http:\/\/www.businesswire.com\/news\/home\/20070201005273\/en\/American-Small-Business-League-Wins-Legal-Battle\" target=\"_blank\" rel=\"nofollow\">ASBL successfully sued NASA<\/a> under the Freedom of Information Act and forced the agency to release documents that uncovered NASA had cheated small businesses out of millions in contracts.<\/p>\n<p>The <a href=\"http:\/\/www.asbl.com\/documents\/Filed_Complaint_For_Injunctive_Relief.pdf\" target=\"_blank\" rel=\"nofollow\">ASBL has filed a lawsuit<\/a> in Federal District Court in <span class=\"xn-location\">San Francisco<\/span> asking the court to grant an injunction to stop federal agencies from diverting federal small business contracts to Fortune 500 firms. <a href=\"http:\/\/www.asbl.com\/showmedia.php?id=2136\" target=\"_blank\" rel=\"nofollow\">ABC<\/a>, <a href=\"http:\/\/www.asbl.com\/showmedia.php?id=2192\" target=\"_blank\" rel=\"nofollow\">CBS<\/a>, <a href=\"http:\/\/www.asbl.com\/showmedia.php?id=2240\" target=\"_blank\" rel=\"nofollow\">NBC<\/a>, <a href=\"http:\/\/www.asbl.com\/showmedia.php?id=2209\" target=\"_blank\" rel=\"nofollow\">CNN<\/a>, <a href=\"http:\/\/www.asbl.com\/showmedia.php?id=2139\" target=\"_blank\" rel=\"nofollow\">CNBC<\/a>, <a href=\"http:\/\/www.asbl.com\/showmedia.php?id=2158\" target=\"_blank\" rel=\"nofollow\">Fox News<\/a> have all reported on the fraud.
