They never sign the tax returns or stay in one place. They are definitely masters of the disappearing act,&#8221; said <span class=\"xn-person\">Lester Crawford<\/span>, chair of the <a target=\"_blank\" href=\"http:\/\/ctec.org\/\" rel=\"nofollow\">California Tax Education Council (CTEC)<\/a>, a state-mandated nonprofit organization that manages the registration of more than 40,000 unlicensed tax preparers.<\/p>\n<p>Tax preparers are required by law to sign (typed or handwritten) federal and state tax returns they prepare for a fee. <\/p>\n<p><span class=\"xn-location\">California<\/span> is one of the few states to set standards for professional tax preparers. State law requires anyone who prepares tax returns for a fee to be either an <a target=\"_blank\" href=\"http:\/\/members.calbar.ca.gov\/fal\/MemberSearch\/FindLegalHelp\" rel=\"nofollow\">attorney<\/a>, <a target=\"_blank\" href=\"http:\/\/www2.dca.ca.gov\/pls\/wllpub\/wllqryna$lcev2.startup?p_qte_code=PA&amp;p_qte_pgm_code=0300\" rel=\"nofollow\">certified public accountant (CPA)<\/a>, <a target=\"_blank\" href=\"https:\/\/ctec.org\/Payer\/FindVerifyPreparer\/\" rel=\"nofollow\">CTEC-registered tax preparer (CRTP)<\/a> or <a target=\"_blank\" href=\"https:\/\/irs.treasury.gov\/rpo\/rpo.jsf\" rel=\"nofollow\">enrolled agent (EA)<\/a>. Each professional must pass an initial test and follow educational requirements. Tax preparers who do business without a legal designation may face penalties up <span class=\"xn-money\">$5,000<\/span> from the <a target=\"_blank\" href=\"http:\/\/ftb.ca.gov\/\" rel=\"nofollow\">California Franchise Tax Board (FTB)<\/a>.<\/p>\n<p>In addition to <span class=\"xn-location\">California<\/span> requirements, tax preparers are required by the <a target=\"_blank\" href=\"http:\/\/irs.gov\/\" rel=\"nofollow\">Internal Revenue Service<\/a> to provide a <a target=\"_blank\" href=\"http:\/\/irs.gov\/ptin\" rel=\"nofollow\">Preparer Tax Identification Number (PTIN)<\/a> on all federal tax returns they prepare for a fee.<\/p>\n<p>&#8220;I think people get scared about reporting tax preparers because they feel like they&#8217;ll get in trouble or are just embarrassed they got taken for a ride,&#8221; said <span class=\"xn-person\">Esperanza Escobedo<\/span>, CRTP and CTEC board member. &#8220;But enforcement teams rely on reports from taxpayers.&#8221;<\/p>\n<p>Beware of tax preparers that\u2026<\/p>\n<ul type=\"disc\">\n<li>List &#8220;self prepared&#8221; on the tax return instead of signing it with their individual name.\n<\/li>\n<li>Stick a business label on the tax return instead of signing it by name. Clients get the &#8220;label&#8221; copy so it looks as though they signed it; however, a blank copy without a business label is often filed.\n<\/li>\n<li>Claim they &#8220;forgot&#8221; to sign the tax return and promise to sign it after you&#8217;ve paid them.<\/li>\n<\/ul>\n<p>Taxpayers can report tax preparers at <a target=\"_blank\" href=\"http:\/\/ctec.org\/\" rel=\"nofollow\">ctec.org<\/a> or visit <a target=\"_blank\" href=\"http:\/\/reporttaxpreparerfraud.org\/\" rel=\"nofollow\">reporttaxpreparerfraud.org<\/a> for more tips.
