Small employers have an additional three years before the changes to daily and weekly overtime pay take effect. <\/p>\n<p>The Labor Commissioner&#8217;s Office has also posted answers to <a target=\"_blank\" href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=2356771-1&amp;h=3197904327&amp;u=https%3A%2F%2Fwww.dir.ca.gov%2Fdlse%2FOvertime-for-Agricultural-Workers-FAQ.html&amp;a=frequently+asked+questions\" rel=\"nofollow\">frequently asked questions<\/a> regarding overtime for agricultural workers.<\/p>\n<p>Agricultural workers are defined in <a target=\"_blank\" href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=2356771-1&amp;h=1095025342&amp;u=https%3A%2F%2Fwww.dir.ca.gov%2FIwc%2FIWCArticle14.pdf&amp;a=Wage+Order+14\" rel=\"nofollow\">Wage Order 14<\/a> and include employees who are engaged in the preparation and treatment of farmland as well as the care and harvesting of crops. Agricultural workers include employees engaged in sheepherding, irrigation and licensed crew members on commercial fishing vessels. <\/p>\n<p>Workers who do not receive proper overtime and other pay can file a <a target=\"_blank\" href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=2356771-1&amp;h=1896775841&amp;u=https%3A%2F%2Fwww.dir.ca.gov%2Fdlse%2FHowToFileWageClaim.htm&amp;a=wage+claim\" rel=\"nofollow\">wage claim<\/a> with the Labor Commissioner&#8217;s Office to begin the process to recover unpaid wages and penalties. Failure to pay proper overtime can result in a civil penalty of <span class=\"xn-money\">$50<\/span> per pay period for each underpaid employee. \u00a0<\/p>\n<p>The Department of Industrial Relations&#8217; Division of Labor Standards Enforcement, or the <a target=\"_blank\" href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=2356771-1&amp;h=389493944&amp;u=https%3A%2F%2Fwww.dir.ca.gov%2Fdlse%2F&amp;a=California+Labor+Commissioner%27s+Office\" rel=\"nofollow\">California Labor Commissioner&#8217;s Office<\/a>, combats wage theft and conducts on-site inspections to investigate and enforce compliance with minimum wage and other <span class=\"xn-location\">California<\/span> labor laws.
