The <span class=\"xn-location\">California<\/span> Attorney General&#8217;s lawsuit asserts that defendants violated antitrust and consumer protection laws by delaying the availability of less expensive generic versions of Provigil<sup>\u00ae<\/sup>. Defendants have denied any wrongdoing. <\/p>\n<p><b><i>No one is claiming that Provigil<sup>\u00ae<\/sup>, Nuvigil<sup>\u00ae<\/sup>, or modafinil is unsafe or ineffective.<\/i><\/b><\/p>\n<p class=\"prntac\"><b><i>Who Is Eligible To Make A Claim?<\/i><\/b><\/p>\n<p>You are eligible to make a claim if you:<\/p>\n<ul type=\"disc\">\n<li>Purchased and\/or paid for Provigil<sup>\u00ae<\/sup>, Nuvigil<sup>\u00ae<\/sup>, and\/or generic versions of Provigil<sup>\u00ae <\/sup>(modafinil), <\/li>\n<li>Were a resident of <span class=\"xn-location\">California<\/span> at the time each purchase was made, <\/li>\n<li>Purchased by you as a caregiver or for your personal consumption, and <\/li>\n<li>Purchased between <span class=\"xn-chron\">June 24, 2006<\/span> and <span class=\"xn-chron\">December 31, 2012<\/span>.<\/li>\n<\/ul>\n<p>You are eligible even if your purchase was reimbursed fully or partially by insurance.<\/p>\n<p class=\"prntac\"><b><i>What Does The Settlement Provide?<\/i><\/b><\/p>\n<p>The Defendants will pay a total of <span class=\"xn-money\">$69 million<\/span> into a Settlement Fund to settle all claims in the <span class=\"xn-location\">California<\/span> Attorney General&#8217;s lawsuit brought on behalf the <span class=\"xn-location\">State of California<\/span> and its consumers.\u00a0 <\/p>\n<p><span class=\"xn-money\">$25,250,000<\/span> of the Settlement Fund has been allocated for claims by eligible consumers. This portion will be distributed to consumers who file a valid Claim Form.
