(&#8220;LG Chem&#8221;), Hitachi Maxell Ltd. and Maxell Corporation of America (&#8220;<span class=\"xn-person\">Hitachi Maxell<\/span>&#8220;), and NEC Corporation (&#8220;NEC&#8221;) (collectively, the &#8220;Settling Defendants&#8221;) agreed to pay <span class=\"xn-money\">$44.95 million<\/span> in Settlements to resolve claims that Settling Defendants allegedly fixed the price of cylindrical Lithium-Ion Batteries, causing individuals and businesses to pay more for products like portable computers, power tools, camcorders or replacement batteries for any of these products.\u00a0 A federal court previously approved the Settlements but is now reconsidering them under a revised Distribution Plan, and will also consider Class Counsel&#8217;s request to reinstate the prior awards of attorneys&#8217; fees and reimbursement of litigation expenses. \u00a0<\/p>\n<p>A more detailed notice, which includes additional information about the settlements, is available at the settlement website (<a href=\"http:\/\/www.reversethecharge.com\" rel=\"nofollow\">www.reversethecharge.com<\/a>) or by calling 1-855-730-8645.<\/p>\n<p><b>What Is This Notice About?<br \/><\/b>This notice is to inform you about recent changes to the proposed Distribution Plan for the Settlements, extended deadlines to exclude yourself from the Settlements or to object to the Settlements, and Class Counsel&#8217;s renewed request for attorneys&#8217; fees and litigation expenses, before the Court decides whether to finally approve the Settlements with Settling Defendants and the revised Distribution Plan.<\/p>\n<p><b>Am I Included?<br \/><\/b>The Class includes all persons and entities who, as residents of <span class=\"xn-location\">the United States<\/span> and during the period from <span class=\"xn-chron\">January 1, 2000<\/span> through <span class=\"xn-chron\">May 31, 2011<\/span>, indirectly purchased new for their own use and not for resale one of the following products which contained a lithium-ion cylindrical battery manufactured by one or more Defendants in this lawsuit or their co-conspirators: (i) a portable computer; (ii) a power tool; (iii) a camcorder; or (iv) a replacement battery for any of these products. &#8220;Indirectly&#8221; means the product was purchased from someone other than the manufacturer, such as a retail store. <\/p>\n<p><b>What Do The Settlements Provide?<br \/><\/b>The Settlement Fund is <span class=\"xn-money\">$44.95 million<\/span>. After deducting Court-approved attorneys&#8217; fees, service awards, notice and administration costs, and litigation expenses, the remaining Net Settlement Fund will be divided into two funds, a Repealer Fund and a Non-Repealer Fund.\u00a0 The Repealer Fund (90% of the Net Settlement Fund) will be available for distribution to Class Members who are residents of the following Repealer States: <span class=\"xn-location\">Alabama<\/span>, <span class=\"xn-location\">Arizona<\/span>, <span class=\"xn-location\">Arkansas<\/span>, <span class=\"xn-location\">California<\/span>, <span class=\"xn-location\">District of Columbia<\/span>, Florida, <span class=\"xn-location\">Hawaii<\/span>, <span class=\"xn-location\">Illinois<\/span>, <span class=\"xn-location\">Iowa<\/span>, <span class=\"xn-location\">Kansas<\/span>, <span class=\"xn-location\">Maine<\/span>, <span class=\"xn-location\">Massachusetts<\/span>, <span class=\"xn-location\">Michigan<\/span>, <span class=\"xn-location\">Minnesota<\/span>, <span class=\"xn-location\">Mississippi<\/span>, <span class=\"xn-location\">Missouri<\/span>, <span class=\"xn-location\">Nebraska<\/span>, <span class=\"xn-location\">Nevada<\/span>, <span class=\"xn-location\">New Hampshire<\/span>, <span class=\"xn-location\">New Mexico<\/span>, <span class=\"xn-location\">New York<\/span>, <span class=\"xn-location\">North Carolina<\/span>, <span class=\"xn-location\">North Dakota<\/span>, <span class=\"xn-location\">Oregon<\/span>, <span class=\"xn-location\">South Dakota<\/span>, <span class=\"xn-location\">Tennessee<\/span>, <span class=\"xn-location\">Utah<\/span>, <span class=\"xn-location\">Vermont<\/span>, <span class=\"xn-location\">West Virginia<\/span>, and Wisconsin.\u00a0 All other states and\/or jurisdictions are &#8220;Non-Repealer&#8221; States.\u00a0 The Non-Repealer Fund (10% of the Net Settlement Fund) will be available for distribution to Class Members who are residents of Non-Repealer States.\u00a0 However, the plan for distributing the Settlement Funds is not final and may be changed by the Court after considering any and all objections by Class Members.\u00a0 If the Court determines that further changes to the allocation of the Settlement Funds between the Repealer and Non-Repealer Fund are appropriate, those changes will be posted on the settlement website (<a target=\"_blank\" href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=2704193-1&amp;h=2200988640&amp;u=http%3A%2F%2Fwww.reversethecharge.com%2F&amp;a=www.reversethecharge.com\" rel=\"nofollow\">www.reversethecharge.com<\/a>), which also provides more details about the Settlements.<\/p>\n<p><b>How Can I Get A Payment And How Much Will I Receive?<br \/><\/b>Money from all settlements in this case will be distributed together on a per-Class Member basis, but the amount you receive from each settlement will depend on the Court-approved Distribution Plan. \u00a0No money will be distributed yet.\u00a0 If final approval is granted to the Settlements with Settling Defendants, Class Members who have already filed a valid and timely claim will receive cash payments.\u00a0 The deadline to file a claim has already passed.\u00a0 The deadline was <span class=\"xn-chron\">July 19<\/span>, 2019.\u00a0 If you did not already file a claim, you will <u>not<\/u> receive a cash payment from the Settlements with Settling Defendants, unless you previously requested to be excluded from the settlement and successfully apply to rejoin the class as described in the Long Form Notice.<\/p>\n<p><b>What Are My Rights?<br \/><\/b>Even if you do nothing, you will be bound by the Court&#8217;s decisions concerning these settlements.
