TRENTON, N.J., Sept. 11, 2026 /PRNewswire-HISPANIC PR WIRE/ — The following notice is being issued by the Court approved Settlement Administrator and has been authorized by the U.S. District Court for the District of New Jersey, in Helene Melzer, et al., v. Johnson & Johnson Consumer Inc., No. 3:22−CV−03149.

A proposed settlement has been reached in a class action lawsuit filed against Defendant Johnson & Johnson Consumer Inc., now known as Kenvue Brands LLC (“Defendant” or “JJCI”). This lawsuit alleges that Defendant violated BIPA by collecting, storing, disclosing, and profiting from the biometric identifiers and/or biometric information of individuals who scanned their faces during a Skin360® skin assessment without first providing legally-required written disclosures and obtaining written consent.

The case is pending in the United States District Court for the District of New Jersey before the Honorable Michael A. Shipp. The proposed settlement is not an admission of wrongdoing by the Defendant, and the Defendant denies it violated the law. The Court has not decided who is right or wrong. Rather, to avoid the time, expense, and uncertainty of litigation, the parties have agreed to settle the lawsuit. The settlement has been preliminarily approved by the Court.

Am I a Member of the Settlement Class?

You are a member of the Settlement Class if you performed a Skin360® skin assessment using any version of Skin360®, including Neutrogena® Skin360®, NeoStrata® Skin360®, and any Skin360® collaborations with other entities, while in Illinois through a mobile application or web application, between December 9, 2019 and May 5, 2023.

What Can I Get From the Proposed Settlement?

If you believe you are a member of the Settlement Class, you can fill out a short Claim Form to be eligible to receive a payment from a $4.7 million Settlement Fund. The Settlement Fund will also be used to pay (a) the Settlement Administrator for the costs of distributing notice and settlement payments, and (b) attorneys’ fees, costs, and expenses to Class Counsel, and service payments to the Class Representatives, if approved by the Court. Any remaining funds that cannot feasibly be distributed to the Settlement Class will be paid to a cy pres recipient to be approved by the Court.

Each Settlement Class Member who submits a timely, valid Claim Form will receive an equal payment from the Settlement Fund. The exact amount of the payment is unknown at this time as it depends on certain factors to be determined, including how many Settlement Class Members submit valid Claim Forms, and the amount of fees, expenses, and awards that may be approved by the Court. What Are My Rights and Options?

File a claim. The only way to get money is to fill out and submit a short Claim Form by November 25, 2026. If the Court approves the proposed Settlement, you will be bound by all orders and judgments in the case.

Do Nothing. You will get no money, but will still be bound by all orders and judgments in the case.

Exclude Yourself. If you do not want money from the Settlement and want to keep your right to file your own lawsuit against Defendant and other Released Parties for any of the claims in the case, you must exclude yourself from the Settlement Class by November 10, 2026.

Object. You can object to the Settlement and Class Counsel’s request for attorneys’ fees and expenses, and the request for a service payment to the Class Representatives if you disagree with them by November 10, 2026.

The Court has appointed lawyers from the firms of Parasmo Lieberman Law, Mazie Slater Katz & Freeman, LLC, and Schwartz Law PLLC to represent you as “Class Counsel.” The lawyers will request to be paid from the Settlement Fund. You can hire your own lawyer, but you will need to pay your own legal fees.

The Court will hold a final hearing on the Settlement of this case at 10:00 a.m. on December 17, 2026 in Courtroom 5W of the United States District Court for the District of New Jersey, Trenton Division, Clarkson S. Fisher Building & U.S. Courthouse, 402 East State Street, Trenton, NJ 08608 (or at such other time or location as the Court may without further notice direct). You can go to this hearing, but you do not have to. If you want, you can hire your own attorney, at your own expense, to appear or speak for you at the hearing. The Court will hear any objections, determine if the Settlement is fair, and consider Class Counsel’s request for attorneys’ fees of up to one third of the Settlement Fund, plus reimbursement of reasonable costs and expenses, and service payments to the Class Representatives in an amount up to $5,000 each. Any money not awarded will stay in the Settlement Fund to pay Class Members who file valid claims.
