Bridger Insurance Notifies Customers and Applicants of Data Security Incident

Bridger has provided details of the incident on its website, https://bridgerins.com/, to inform potentially impacted individuals of this incident and to provide resources to assist them. 

In September 2018, Bridger contacted its third-party IT provider to help resolve issues with its network. During this process, Bridger became aware of potential unusual access to one of its servers. Bridger launched an internal investigation to determine the nature of this potential access, and on September 14, 2018, Bridger shut down the potentially impacted server. As part of its investigation, Bridger engaged an independent third party computer forensics firm to investigate the incident. Based on the forensics investigation, Bridger ultimately determined that personal information relating to insurance applications may have been affected by this incident. Since that time, Bridger worked diligently to identify those individuals whose personal information may have been involved. 

This information may have included customer/applicant names, addresses, Social Security numbers, dates of birth, driver’s license information, vehicle information and record histories, and prior insurance claims information. 

Bridger’s website notification includes information about the incident and steps that potentially impacted individuals can take to monitor and protect their personal information. Bridger has established a toll-free call center which can be reached at 1-877-204-9536. Although Bridger is not aware at this time of any misuse of impacted information, Bridger will provide potentially impacted individuals with complimentary identity monitoring services for 12 months through TransUnion. Overview of the Administrative Proceeding

On May 1, 2012, the Commission issued an order (“Order”)1 finding that from May 15, 2008 through September 30, 2009, UBS PR made misrepresentations and omissions of material facts to investors in Puerto Rico regarding the secondary market liquidity and pricing of the Funds (“Mispriced Transactions”). In addition, the Commission found that from March 1, 2009 through September 30, 2009, UBS PR effectively prevented investors from selling their Fund shares by failing to execute marketable sell orders placed by the investors (“Delayed Sales Transactions”). 

In accordance with the Order, UBS PR paid $26,609,739.94 to the Commission that consisted of $11,500,000.00 in disgorgement, $1,109,739.94 in prejudgment interest, and a $14,000,000.00 civil money penalty. The Order created the Fair Fund pursuant to Section 308(a) of the Sarbanes-Oxley Act of 2002, as amended. UBS PR paid the total $26,609,739.94 as ordered (the “Fair Fund”). The purpose and intent of the Distribution Plan is a fair and reasonable distribution of the Fair Fund to investors harmed by UBS PR’s conduct described in the Order.

The Distribution Plan has been approved by the Commission and the Commission retains jurisdiction over implementation of the Distribution Plan.

Who is Eligible

The purpose and intent of the Distribution Plan is a fair and reasonable distribution of the Fair Fund to investors harmed by UBS PR’s conduct. The Plan of Allocation, as more fully described in the Distribution Plan, contains two methodologies for calculating investors’ harm: one for Mispriced Transactions and one for Delayed Sale Transactions.

The first methodology, for Mispriced Transactions, is for investors who bought or sold shares of one or more of the Eligible Securities from May 15, 2008 through September 30, 2009, and whose investments were affected by the misrepresentations and omissions by UBS PR regarding pricing of their investment.

The second methodology, for Delayed Sale Transactions, applies to those investors who submitted marketable orders to sell between March 1, 2009 and September 30, 2009, and whose transactions were not executed by UBS PR, either in part or in full. For the Delayed Sale Transactions, investors are eligible to submit a claim as long as investors subsequently placed another order to sell shares and the shares were sold by the close of the markets on January 16, 2018 (the last date on which closing prices are available) and incurred harm as defined by the Plan of Allocation.

Higher Income May Prove Elusive for Many College Grads

PRINCETON, N.J., March 21, 2019 /PRNewswire-HISPANIC PR WIRE/ — Earning a bachelor’s degree has become a basic goal for high school students, but many college graduates with a four-year degree find themselves struggling to earn enough money to achieve their version of the American dream. In fact, a significant percentage earn no more than a high school graduate. How is that possible?

Skills and the Earnings of College Graduates” shows that there is a significant number of four-year degree holders who failed to develop necessary skills in the critical areas of literacy and numeracy. As a result, they will likely find the higher income they were seeking by attending college and earning a degree to be a mirage.

These findings come in the context of expanding “college-for-all” policies in states across the nation. Yet this study, from Neeta Fogg, Paul Harrington and Ishwar Khatiwada of Drexel University’s Center for Labor Markets and Policy, suggests that the increasing emphasis on attaining a bachelor’s degree is fraught with risks that are partially mitigated by attaining commensurate levels of literacy and numeracy proficiencies. The authors found that employers value graduates with better literacy and numeracy skills and reward them with higher earnings — even after accounting for worker characteristics, major field of study and the type of occupation in which the worker is employed.

“Unfortunately, even as the numbers of college graduates have increased, many fail to acquire the minimum or college-graduate level of skills,” said Harrington, Director of Drexel’s Center for Labor Markets and Policy. “One out of every five adult non-elderly workers with a bachelor’s degree lacks minimum skills in literacy; for numeracy, the number is one in three. Employers seeking workers find that a four-year college diploma is not a guarantee of strong literacy or numeracy skills. And, individuals without these skills are at risk of losing the financial rewards of high earnings.”

“While there are other human-capital factors that affect future earnings, such as years of work experience and your college major, nothing is more important than having adequate literacy and numeracy skills,” Fogg said. “It’s of paramount importance that we focus more on giving young adults the skills they need to thrive in the labor market. Credentials without skills are quickly exposed in the American labor market.”

Irwin Kirsch, Director of the ETS Center for Research on Human Capital and Education, which commissioned the study, said the study dovetails with recent findings published in other Center policy reports. In “Too Big to Fail: Millennials on the Margins” (2018), it was found that nearly half of all Americans between ages 16 and 34 demonstrated low literacy skills, and more than half demonstrated low numeracy skills.

“These new findings should be an important signal to policymakers and leaders throughout the educational community that there is clear evidence indicating that significant numbers of high school and college graduates demonstrate insufficient levels of literacy and numeracy skills that are required for modern societies,” Kirsch said.

Key findings included the following:

  • The study found that the gains to a bachelor’s degree while very substantial are well below the widely reported college graduate earnings premiums relative to high school graduates that do not account for the role of foundational skills in determining the earnings of workers.
  • The average monthly earnings of graduates with a bachelor’s or higher college degree who were working in college-level occupations were double those of mal-employed college graduates ($7,200 per month versus $3,600). Mal-employed refers to college graduates working in non-college level jobs; that is, jobs that do not require the skills and knowledge typically attained from a college education.
  • The average monthly earnings of college graduates with insufficient skills (below minimum) was $5,300, far less than the $7,300 for those with above minimum skill levels.

The authors’ findings are based on analysis of the Survey of Adult Skills of the Programme for the International Assessment of Adult Competencies (PIAAC), an international assessment measuring achievement for countries across the world. They used data for the United States from 2011–2014.

Minor League Baseball Expands “Copa de la Diversión” for 2019

PETERSBURG, Florida, March 21, 2019 /PRNewswire-HISPANIC PR WIRE/ — Minor League Baseball™ (MiLB™) this week revealed the on-field identities of the 72 teams participating in its 2019 “Copa de la Diversión™” (“Fun Cup™”) competition. Entering its second season, Copa de la Diversión (“Copa”) serves as the centerpiece of MiLB’s “Es Divertido Ser Un Fan™” (“It’s Fun to be A Fan™”) Hispanic fan engagement initiative.

The inaugural campaign in 2018 far exceeded community impact, fan engagement and game attendance projections, earning numerous awards and recognitions for its authentic approach to engaging with Hispanic communities nationwide. In 2018, Copa de la Diversión games drew significantly larger crowds – 24.4 percent larger – than non-Copa games. Overall attendance for the Copa-designated games was 12.6 percent more than attendance for the same dates in 2017.

On Monday, Sports Business Journal unveiled its 2019 Sports Business Award nominees, naming Minor League Baseball: Copa de la Diversión one of four finalists for its “Sports Breakthrough of the Year” award, with winners to be announced at the Sports Business Awards on May 22 in New York City.

“We worked for more than three years researching and developing the Copa de la Diversión platform, and we knew that if we built an authentic, culturally-relevant campaign, our entire fan base – not just Hispanic fans – would embrace it,” said Kurt Hunzeker, Minor League Baseball’s vice president of marketing strategy and research. “The way Copa resonated with our communities almost immediately after we started unveiling the identities last year truly signaled that our focus, direction and execution was correct. The positive fan feedback coupled with the quantifiable increases in key metrics helped shape our strategy as we prepare for more ‘divertido’ this season.”

Building off the inaugural season’s successes, all 33 MiLB teams that participated in Copa last year are returning in 2019, joining 39 additional teams seeking to strengthen their connections with Hispanic fans in their respective communities. By the end of this week, all 72 participating Copa teams will have held unveiling events showcasing their culturally-relevant on-field personas honoring the local Hispanic community. Each participating team will adopt these new personas via on-field jerseys and caps during 397 Copa-designated games throughout the 2019 season.

MiLB also introduced a new, Copa-specific website featuring each participating team’s unique identity, the story behind its Hispanic on-field persona and links for fans to purchase tickets to the Copa ballpark events and order merchandise, including on-field caps, T-shirts and other branded apparel.

Labor Commissioner’s Office Recovers $1 Million in Unpaid Wages for 239 Restaurant Workers

SAN JOSE, Calif., March 18, 2019  /PRNewswire-HISPANIC PR WIRE/ — The Labor Commissioner’s Office has obtained a $1 million settlement from the owners of San Jose restaurant chain Burrito Factory to recover unpaid wages for 239 workers. The settlement is secured by the owner’s property assets.

“This case is the latest in a string of investigations by the Labor Commissioner’s Office that has resulted in putting earned wages into workers’ pockets,” said California Labor Secretary Julie A. Su. “The message is clear: compliance with labor standards in California is not optional. When workers who are not paid come forward and demand their just day’s pay, the State is on their side.”

The owners operated the chain of Mexican restaurants at four locations in San Jose. In October 2017, the Labor Commissioner’s Office opened its investigation following a Private Attorneys General Act complaint. Investigators found that the employers did not pay workers properly for overtime or split shifts, which resulted in workers receiving less than the minimum wage for their work. The Burrito Factory also failed to provide workers a meal break as required by law, often paid workers in cash and did not keep accurate payroll records.

The Labor Commissioner’s Office entered into mediation talks with the restaurant chain in February after citations were issued for the labor law violations and the employer demonstrated its willingness to comply with state labor laws. The parties reached a settlement agreement to pay the workers $1 million with an additional $100,000 in civil penalties, payable beginning this July.

Enforcement investigations typically include a payroll audit of the previous three years to determine minimum wage, overtime and other labor law violations, and calculate payments owed and penalties due. Civil penalties collected are transferred to the State’s General Fund as required by law.

The Department of Industrial Relations’ Division of Labor Standards Enforcement, or the California Labor Commissioner’s Office, combats wage theft and conducts on-site inspections to investigate and enforce compliance with minimum wage and other California labor laws. Its wide-ranging responsibilities include public works enforcement, retaliation complaint investigations, licensing and registration, as well as multilingual labor law education and outreach for workers and employers.

In 2014, the Labor Commissioner’s Office under Julie A. Su’s leadership launched the Wage Theft is a Crime multilingual public awareness campaign. The campaign defines wage theft and informs workers of their rights and the resources available to them to recover unpaid wages or report other labor law violations.
