Ivan And Simona Aguilera, The Son And Daughter-In-Law Of The Late Juan Gabriel, File $100 Million Defamation Lawsuit Against Univision, Telemundo And Other Defendants

MIAMI, May 22, 2017 /PRNewswire-HISPANIC PR WIRE/ — Ivan and Simona Aguilera, the son and daughter-in-law of the late Mexican icon, Juan Gabriel, have filed suit in Florida state court in Miami-Dade County against Univision, Telemundo and other defendants for defamation and related causes of action.

The amended complaint alleges that the defendants have falsely stated, among many other defamatory statements, that Ivan contributed to his father’s death; that Ivan and Simona “robbed” Juan Gabriel and/or his estate of properties; and that Ivan and Simona have handled the estate against Juan Gabriel’s wishes.  The amended complaint states that all of these statements are 100% false and highly defamatory.

At the time these defamatory statements were made, Ivan and Simona Aguilera were in mourning, and also were organizing a public memorial for Juan Gabriel, organizing a public tribute concert featuring his music, with proceeds to be donated to a charity for poor children, and were managing Juan Gabriel’s estate consistent with his expressed wishes.

The lawsuit will seek in excess of $100 million in damages against Univision, Telemundo and the other defendants.

Cal/OSHA Urges Employers to Prepare For Sizzling Temperatures

OAKLAND, May 19, 2017 /PRNewswire-HISPANIC PR WIRE/ — As Northern California braces for triple digit temperatures, Cal/OSHA urges all employers to revisit their Injury and Illness Prevention Programs and their emergency response procedures to make sure they are thoroughly prepared for high heat. Sacramento’s National Weather Service is forecasting temperatures in the 90s today and through the weekend. Early next week temperatures will reach triple digits in much of Northern California, from south of Stockton up to Redding.

“During heat waves and whenever temperatures reach or exceed 95 degrees, employers must take additional steps to monitor workers for signs and symptoms of heat illness,” said Cal/OSHA Chief Juliann Sum. “Water, rest and shade can protect workers from the heat.”

California’s outdoor workplace Heat Illness Prevention regulations require employers to take four steps to prevent heat illness:

  • Training – Train all employees and supervisors on heat illness prevention.
  • Water – Provide enough fresh water so that each worker can drink at least 1 quart per hour, and encourage workers to do so.
  • Shade – Provide shaded areas upon request or when temperatures exceed 80 degree, and encourage any worker to take a cool-down rest in the shade for at least 5 minutes to protect against overheating. Workers should not wait until they feel sick to cool down.
  • PlanningDevelop and implement effective written emergency response procedures for complying with Cal/OSHA’s Heat Illness Prevention Standard.

Cal/OSHA will inspect outdoor worksites of industries such as agriculture, construction, and landscaping throughout the heat season. Cal/OSHA’s Heat Illness Prevention program, the first of its kind in the nation, includes enforcement of heat regulations as well as multilingual outreach and training for California’s employers and workers.

CDC and March of Dimes partner on new initiative for babies exposed to drugs during pregnancy

WHITE PLAINS, N.Y., May 19, 2017 /PRNewswire-HISPANIC PR WIRE/ —  The March of Dimes, in collaboration with the U.S. Centers for Disease Control and Prevention (CDC), has awarded grants to conduct one year of surveillance on neonatal abstinence syndrome (NAS) in three states with high rates of NAS: Vermont, Illinois, and New Mexico. The project will enable each state to conduct enhanced identification of babies born with NAS and evaluate the health services needed by these babies through one year of age.

BMW, Mazda, Subaru and Toyota Announce Settlement of Takata Economic Loss Claims to Improve Recall Remedy Completion Rates

MIAMI, May 18, 2017 /PRNewswire-HISPANIC PR WIRE/ — BMW, Mazda, Subaru and Toyota (the automakers) today announced agreements to resolve economic loss claims in the Takata multidistrict litigation (MDL) in the United States. The programs offered in these agreements are intended to increase recall remedy completion rates for Takata airbag inflators, among other customer benefits. 

The Takata airbag inflator recall is the largest such action in history and affects more than 42 million vehicles in the United States, across 19 automakers. Given the size, scope and severity of the Takata recall, these automakers are the first to agree to a settlement structure to fund consumer outreach, rental car/loaner programs and out-of-pocket cost reimbursement. The automakers have jointly agreed to provide a total of approximately $553 million for these activities.

If the proposed settlements are approved as final by the U.S. District Court for the Southern District of Florida, the automakers will separately support the following activities, which will be conducted under the supervision of a court-appointed Settlement Special Administrator, subject to the terms and conditions of each agreement:

  • Outreach Program: The Settlement Special Administrator will oversee and administer outreach programs with the goal of significantly increasing Takata recall remedy completion rates among customers of the four automakers through traditional and non-traditional means. The programs, intended to start before final approval of the agreements, build upon extensive work these automakers have already done to reach the owners of affected vehicles and will be conducted in conjunction with the National Highway Traffic Safety Administration (NHTSA)’s Coordinated Remedy Program.
  • Rental Car Loaner Program: Apart from any existing rental car loaner programs, the automakers will make rental or loaner vehicles available upon request to eligible customers, as defined in the respective settlement agreements, and for whom parts are not available within 30 days. This program will begin 30 days after preliminary approval of the agreement.
  • Out-of-Pocket-Claims and Residual Distribution: Eligible customers may submit requests for reimbursement of reasonable out-of-pocket expenses related to the Takata airbag inflator recalls and/or may register for residual payments. The Settlement Special Administrator will determine the types of reimbursable costs and class members’ eligibility to receive payments for these claims.  
  • Fees and Administration: Costs related to class member notification, claims administration, attorneys’ fees and expenses, class representative awards, and any other costs are also covered under the proposed settlements.

Further, in addition to performing the recall remedy, the automakers will each offer a Customer Support Program (CSP) for vehicles covered by these proposed settlements. The CSPs will provide prospective coverage for repairs and adjustments (including parts and labor) needed to correct defects in materials or workmanship in the Takata phase stabilized ammonium nitrate (“PSAN”) inflators contained in the affected airbag modules or any replacement inflators installed as part of the remedy, subject to the terms and conditions of each agreement.

These agreements cover the four automakers’ vehicles already recalled or subject to any future recall for Takata PSAN inflators used in driver or front passenger airbag modules,* as described in NHTSA’s 2015 Consent Orders and any amendments. Importantly, these agreements do not contain or constitute any admission of liability or fault by the four automakers.

*Note – Subaru vehicles are not equipped with driver-side Takata airbags.
