Cal/OSHA Cites Poway Energy Technology Company $58,025 for Industrial Flywheel Explosion that Injured Four Workers

SAN DIEGO, Dec. 9, 2015 /PRNewswire-HISPANIC PR WIRE/ — Cal/OSHA today cited Quantum Energy Storage Corporation in Poway $58,025 for a June 10 explosion caused by an out-of-control 11,000 pound metal flywheel. One worker suffered a broken ankle and three others were treated for abrasion injuries caused by flying debris from the explosion.

California employers must take precautions to protect employees from on-the-job hazards, including machinery operated in closed, confined spaces,” said Cal/OSHA Chief Juliann Sum.  “The workers harmed by this explosion could have died because the employer did not secure or cover the flywheel to prevent the release of mechanical energy.”

Cal/OSHA investigators learned that the nearly seven feet in diameter flywheel was placed in a concrete vault area installed in the warehouse for tests of the energy storage system. Prior to the accident, the flywheel was spinning at 6,000 rotations per minute, and had just begun the process of winding down when it failed. The flywheel came loose from its moorings and crashed into the vault’s guard rails, causing enough damage to the building’s roof, interior and walls that the building was deemed unsafe to enter after the accident.

No steps had been taken to enclose the vault or minimize hazards where the employees worked. Computer stations were not located at a safe distance nor were they designed to limit employee exposure in the event of uncontrolled release of electrical or mechanical energy.

Cal/OSHA issued 16 citations to Quantum Energy Storage for violations of multiple health and safety standards, including the safe practices for operating machinery standard. The citations included five that were serious in nature and one classified as serious accident-related. A serious violation is cited when there is a realistic possibility that death or serious harm could result from the actual hazardous condition.

Mood-Altering Drug Use During Pregnancy: The Risks Of Medical Marijuana And Prescription Opioids

NEW YORK, Dec. 10, 2015 /PRNewswire-HISPANIC PR WIRE/ — Marijuana is the most commonly-used illegal drug during pregnancy, and now that it has been legalized in many states, either for recreational or medical use, health care providers are becoming more concerned about the health risks it poses for babies.

Opioid-based prescription painkillers are also commonly used by women of childbearing age in the United States, and the incidence of neonatal abstinence syndrome (NAS), a phrase used to describe the serious withdrawal symptoms that babies can face, increased five-fold nationwide between 2000 and 2012.

Two leading experts presented the latest scientific findings about the risks of short-term and long-term consequences to babies from these mood-altering drugs when taken during pregnancy and while breastfeeding. Jennifer N. Lind, PharmD, MPH, a pharmacist and epidemiologist with the U.S. Centers for Disease Control and Prevention, and Larry Wolk, MD, MSPH, Executive Director and Chief Medical Officer of the Colorado Department of Public Health and Environment, spoke at an editorial luncheon sponsored by the March of Dimes today.    

Nearly five percent of pregnant women report using marijuana, said Dr. Wolk. 

“There is no known safe amount of marijuana use during pregnancy, and it can pass from mother to the unborn baby; and it can be passed through breast milk,” he said. “The health consequences may not appear until the child is in school and having difficulty learning or paying attention.”

Both the American College of Obstetricians and Gynecologists and the American Academy of Pediatrics recently issued statements outlining their concerns about the risk of marijuana use during pregnancy and the risks to babies.

Dr. Lind noted that many women are unaware that taking prescription opioid-based medications such as codeine, oxycodone, hydrocodone, or morphine, during pregnancy may increase the risk for some birth defects and other poor pregnancy outcomes (such as miscarriage and premature birth), in addition to NAS.  “If you’re pregnant or thinking about becoming pregnant, don’t start or stop taking any medications without first talking with a healthcare provider,” she said. She also urged doctors to discuss the potential risks and benefits of opioid medications with women of childbearing age and pregnant women, before prescribing.

In November 2015, the federal Protecting Our Infants Act was signed into law by President Obama. This legislation will support efforts to collect and share strategies and best practices to prevent and treat maternal opioid use and abuse, as well as provide recommendations for diagnosing and treating babies suffering from withdrawal.

DIR Reminds Public Works Contractors to Renew Registration before January 1 to Avoid Hefty Penalty

Contractors whose public works contractor registration expired June 30, 2015, and have ongoing public works projects or plan to bid on new ones, must pay the $300 renewal fee before January 1, 2016 or face an additional $2,000 late penalty after that date.

As a result of Senate Bill 854, all contractors have been required since April 1, 2015, to register with DIR to be awarded a public works contract, even if the project did not go out to bid.

If you believe that your public works registration with DIR is still active, you can check the active contractor registration search tool to locate and confirm your registration. If your registration does not appear, it may have expired or you were not registered. DIR’s Frequently Asked Questions page has more information.

If you were registered last year and have not bid nor worked on any public works projects on or after July 1, 2015, you can renew for this fiscal year without incurring a penalty.

The required annual registration fee of $300 is used to fund such activities as DIR’s compliance monitoring and enforcement, prevailing wage and public works coverage determinations, and enforcement appeal hearings.

DIR registration requires that all contractors affirm under penalty of perjury that they have workers’ compensation insurance coverage, have no outstanding wage judgments, and are licensed with the Contractors State License Board.  

DIR maintains a listing of registered contractors and subcontractors on its website to assist awarding bodies who must confirm this registration before considering a bid or awarding a contract, and for contractors who must confirm that their bid team members are registered. DIR’s Division of Labor Standards Enforcement (DLSE), also known as the Labor Commissioner’s Office, enforces prevailing wage rates and apprenticeship standards in public works projects, inspects workplaces for wage and hour violations, adjudicates wage claims, investigates retaliation complaints, issues licenses and registrations for businesses and educates the public on labor laws.
