ANAHEIM, California, May 25, 2017 /PRNewswire-HISPANIC PR WIRE/ — Guests become the protagonists of a rockin’ new adventure in Disney California Adventure Park as they help rescue a cosmic gang of misfits in Guardians of the Galaxy – Mission: BREAKOUT! This thrilling attraction is fueled with high-energy, hilarious action that will be fun for Super Hero fans and those who are discovering this story for the first time. It opens May 27, 2017.

Guardians of the Galaxy – Mission: BREAKOUT! entices guests with an original storyline based on “Guardians of the Galaxy” films, comics and animated television series, with a rapid rise into chaotic adventure and surprising visuals. The fast-paced action rocks to the beat of music inspired by the films’ soundtracks, including classic rock and pop music from the ’60s, ’70s and early ’80s. And with multiple ride profiles, guests never know which adventure they’ll get.

“Guardians of the Galaxy – Mission: BREAKOUT! brings an all-new epic adventure to the Disneyland Resort, and it’s the only Disney park in the universe where guests can step into a Guardians of the Galaxy story,” said Bob Chapek, chairman of Walt Disney Parks and Resorts.  “Like the smash-hit films that inspired it, this new attraction is action-packed, full of irreverent humor, and features an ‘awesome mix tape.’  It’s a fantastic way for guests to experience the Super Hero universe like never before.”

Guardians of the Galaxy – Mission: BREAKOUT! opens just weeks after the theater premiere of the new film, “Guardians of the Galaxy, Vol. 2.” The stars of the films are featured in the attraction.

Walt Disney Imagineering collaborated with James Gunn, director of the “Guardians of the Galaxy” films, Kevin Feige, president of Marvel Studios, most of the main talent from the films along with Joe Quesada, chief creative officer, Marvel Entertainment, and Marvel Themed Entertainment on the story of the attraction, to develop an experience where guests step into a story with these characters for the first time.

“I can’t be more pleased to have partnered with Walt Disney Imagineering in bringing the Guardians of the Galaxy characters to this new, immersive form of storytelling,” Gunn said. “It’s been exciting and a lot of fun to help direct and shape the experience so that it has all the heart and fun and humor of the Guardians movies.”

In addition to the new attraction, Summer of Heroes begins May 27 with Guardians of the Galaxy characters and Super Heroes appearing in Disney California Adventure for new exploits and Heroic Encounters. While some of these will be year-round, others will be available only from May 27-Sept. 10. Summer of Heroes inaugurates an ever-expanding universe of Super Hero stories at Disney California Adventure that will become even bigger over time.

The Collector’s Fortress

The Guardians of the Galaxy – Mission: BREAKOUT! adventure begins as guests enter a grandiose, 183-foot tall fortress. They discover that the Guardians have been imprisoned by the arrogant, acquisitive Taneleer Tivan, known as The Collector. Guests join a daring escape plan devised by Rocket, who once again proves his uncanny ability to break free from any prison or captivity.

The dominating fortress is adorned with antennae, satellite dishes and other mysterious apparatus and is accented in shimmering hues of blue and gold. At night, with special lighting, it pulsates with imposing power. A gilded, eight-foot-tall statue of The Collector stands at the entrance to the fortress, towering over guests. These VIP guests of The Collector enter to view the unique “Tivan Collection” of relics and species from all over the universe. His latest acquisition: The Guardians of the Galaxy.

The Fortress Lobby

The Lobby of the fortress is both fascinating and creepy – filled with display cases that hold artifacts and living creatures, which The Collector has obtained and made available for public viewing. In a welcome video, The Collector explains how he has trapped the Guardians of the Galaxy high atop his fortress in secured glass cages that are wired with power from a massive generator and suspended over a deep abyss.

The Collector’s Office

Before leaving the Lobby and entering The Collector’s Office, guests hold up their hands to be “bio-scanned” for security clearance. In the Office, even more of The Collector’s relics are on display and, as in the Lobby, the collection contains some hidden references that will delight dedicated Super Hero fans and Disney fans.

Suddenly, Rocket appears, telling guests he needs their help. Using their security clearances, he can hijack the gantry lift to the top of the fortress, disable the generator, and free his friends.

The Gantry Lift

Of course, Rocket’s plan faces challenges. After guests enter the gantry lift, Rocket overrides The Collector’s recorded tour spiel with music from the tape player of Star-Lord (aka Peter Quill). Soon, the gantry is shooting up into the fortress, then plummeting downward as Rocket attempts to take control of the generator.

It’s here that guests experience one of the attraction’s six different ride profiles, each synchronized to one of the songs on the “awesome mix tape”:

  • “Hit Me With Your Best Shot” by Pat Benatar
  • “Give Up The Funk” by Parliament
  • “Born To Be Wild” by Steppenwolf
  • “I Want You Back” by The Jackson 5
  • “Free Ride” by The Edgar Winter Group
  • “Burning Love” by Elvis Presley

Guests soon learn that, even if the rescue is successful, the resulting chaos may create problems of its own!

The Technology

To help create the attraction, Disney Imagineers used Virtual Reality technology to pre-visualize the Tivan Collection, The Collector’s Office and other parts of the Guardians of the Galaxy – Mission: BREAKOUT! experience.

The ride system has more high-speed ride time than ever before, and the thrill factor gets going as soon as the gantry lift doors close and the music stars blaring. Each song is accompanied by a different up-and-down ride profile and story scenes, making every visit to the attraction unpredictable.

Rocket makes multiple appearances in the attraction, including as a sophisticated Audio-Animatronics character who invades The Collector’s Office to ask guests for a hand with his escape plan.

From the anticipation guests will feel as they enter The Collector’s Fortress to the sense of discovery as they tour the Tivan Collection to the thrills and elation of participating in a successful breakout, Guardians of the Galaxy – Mission: BREAKOUT! is an unforgettable adventure into the Super Hero universe at Disney California Adventure.

U.S. District Court Upholds Labor Commissioner Awards of Almost $1 Million for Misclassification of Port and Rail Truck Drivers

0

LOS ANGELES, May 23, 2017 /PRNewswire-HISPANIC PR WIRE/ — A federal court judge has sided with California Labor Commissioner Julie A. Su, issuing a judgment in favor of five port and rail truck drivers against XPO Cartage Inc. The ruling awards the drivers reimbursement for expenses and unlawful deductions in the amount of $958,660 plus attorney’s fees and costs.

The Labor Commissioner previously issued awards to the five drivers following hearings that found they had been misclassified as independent contractors. XPO Cartage appealed the five decisions in Superior Court and the case was removed to Federal Court, where attorneys for the Labor Commissioner defended the decisions on behalf of the drivers. After a four-day bench trial and post-trial briefing, U.S. District Court Judge William Keller ruled the cases were not preempted by the Federal Aviation Administration Authorization Act of 1994 and that all five drivers, misclassified as independent contractors, were entitled to reimbursement for expenses and unlawful deductions.

“The United States District Court’s decision in this case vindicates the rights of five employees who have sought for years to recoup the deductions unlawfully withheld from their wages due to being misclassified as independent contractors,” said Labor Commissioner Julie A. Su. “My office is dedicated to ensuring workers are paid what they are due under the law and ensuring workers are properly classified.”

State courts have also upheld the Labor Commissioner’s awards in misclassification cases in the port and rail trucking industry. In 2013, Superior Court Judge Michael Vicencia rendered judgment in favor of four port truck drivers and against Seacon Logix Inc. in the amount of $107,802.  The Second District Court of Appeal affirmed Judge Vicencia’s judgment in its published decision Garcia v. Seacon Logix, Inc. (2015) 238 Cal.App.4th 1476. In 2015, Superior Court Judge Ross Klein also affirmed the Labor Commissioner’s finding of misclassification and awarded port truck driver Ho Lee $179,390 for reimbursement of expenses and unlawful deductions following a three day bench trial.

The federal courts over the past four years have consistently upheld the Labor Commissioner’s authority to adjudicate these claims and rejected complaints that wage claims filed by truck drivers with the Labor Commissioner are preempted under the Federal Aviation Administration Authorization Act of 1994:

  • Clean Truck Coalition, et al. v. Julie Su, Labor Commissioner of the State of California, Department of Industrial Relations, in her official capacity, et al., Case No. 2:12-cv-08949-MMM-AJW;
  • Seacon Logix, Inc. v. Division of Labor Standards Enforcement, Case No. BC504306;
  • Winwin Logistics, Inc. v. Julie Su, Labor Commissioner, California Department of Industrial Relations, Division of Labor Standards Enforcement, Case No. 2:15-cv-04624-CAS (PJWx);
  • Sterling Express Services, Inc. v. Jose Vasquez, an individual; Division of Labor Standards Enforcement, by and through Julie Su, in her official capacity as Labor Commissioner, et al., Case No. 2:14-cv-01308-DSF-VBK;
  • Sterling Express Services, Inc. v. Johel Climaco Valencia, an individual; Division of Labor Standards Enforcement, by and through Julie Su, in her official capacity as Labor Commissioner, et al., Case No. 2:14-cv-00137-R-JCGx.

Dynamic Performance
The 2018 Odyssey is powered by a new 3.5-liter direct injected i-VTEC® 24-valve SOHC V6 engine with Variable Cylinder Management™ (VCM™). This new engine is paired with one of two new transmissions: a 9-speed automatic (9AT) for LX, EX, EX-L and EX-L NAVI RES trims, or an all-new Honda-developed 10-speed automatic (10AT) for Touring and Elite trims. The Odyssey’s new engine is rated at 280 SAE net peak horsepower (+32 horsepower) and 262 SAE net lb.-ft. torque (+12 lb.-ft.) and delivers best-in-class acceleration for added confidence when entering a freeway, accelerating with traffic or overtaking another vehicle on the highway.

Odyssey’s superior performance, including its exceptional ride comfort, and steering and handling precision, are improved by a lighter weight, more rigid body structure (75 pounds lighter with a 44 percent increase in torsional rigidity compared to the previous model), as well as a new dual-pinion electric power steering system, and a new rear suspension with stabilizer bar. The new suspension allows for more discreet control of both body roll (side-to-side) and heave (up and down) body motions, while its compact design aids interior cargo volume. It is also 15 pounds lighter than the previous system.

Magic Slide Seats
Odyssey’s new Magic Slide 2nd-row seats™ enable greater flexibility for optimal passenger comfort, people- and cargo-hauling ease and easy access to the third row. There are four different modes depending on the space and seat position that is needed, with the center seat removed.

The Easy Access mode allows the outboard seats to slide laterally through five selectable positions, creating more access to the third row, even with one or two rear-facing child seats installed in the second row seats. The Super mode can be used for maximum access to the back row with either outboard seat set to walk-in position. To have the two outboard seats in their outer most positions is called Wide mode. Lastly, the Buddy mode enables the two outboard seats to come together in the center of the vehicle, putting the two people in close proximity to one another.  Further, sliding either outboard second-row seat to its center- and forward-most position puts a child within easy reach of the driver and front-seat passenger.

Family Connectivity
A host of new connected-vehicle features and technologies makes the in-vehicle communication easier and faster. CabinWatch™ lets the driver and front passenger view the second- and third-row passengers via the 8-inch Display Audio screen, using a ceiling-mounted camera with infrared capability. The new CabinTalk™ in-car public address system allows the driver to talk with the second- and third-row passengers through the third-row speakers in equipped models and the Rear Entertainment System, through the wireless headphones and third-row headphone jacks.

Cabin Quietness

The Odyssey’s vault-like cabin benefits from a more aerodynamic and tightly sealed body; the use of triple door seals; an acoustic-laminated windshield and front door glass (Elite trim); thicker rear-door, rear-quarter and rear windscreen glass (Elite trims add acoustic rear-quarter glass); added insulation in the engine compartment and fenders; the application of acoustic spray foam to 14 places in the body structure; and standard Active Noise Control technology.

Safety and Driver Assistive Features
The 2018 Odyssey EX and above trims now feature the Honda Sensing® suite of advanced safety and driver-assistive technologies as standard equipment. Honda Sensing® includes Collision Mitigation Braking System™ (CMBS™), Lane Keeping Assist (LKAS), Road Departure Mitigation (RDM) and Adaptive Cruise Control (ACC). The new Odyssey also utilizes the latest generation of Honda’s Advanced Compatibility Engineering™ (ACE™) body structure and advanced airbags. The new Odyssey targets top collision safety ratings: an NCAP 5-star Overall Vehicle Score and an IIHS TOP SAFETY PICK rating.
