  • Good tree pruning can prevent many problems associated with a hail storm. Prompt removal of diseased, damaged, or dead plant parts helps reduce the possibility of future storm damage.

DIR Releases Status Report on Process Safety Management Regulatory Oversight of California’s Petroleum Refineries


SACRAMENTO, Calif., April 13, 2015 /PRNewswire-HISPANIC PR WIRE/ — Christine Baker, Director of the Department of Industrial Relations (DIR), has submitted a legislatively-mandated status report on DIR and Cal/OSHA’s Process Safety Management (PSM) Regulatory Oversight. The report is required pursuant to the Budget Act of 2014 (Provisions 1 and 2 of item 7350-001-3121, Chapter 25, Statutes of 2014).

“This report gives a description of appropriate funding allotted to our PSM Unit, which has allowed us to design and implement a new approach for regulating the petroleum refining industry,” said Christine Baker, DIR Director.

A new assessment on the state’s oil refineries, implemented by DIR in 2013, requires refineries to provide funding support to DIR for Cal/OSHA’s PSM refinery program. The funds, which are independent of the state’s General Fund, have allowed DIR to expand the PSM staff from 10 positions in 2012 to 26 positions and supported eleven weeks of advanced technical training for the refinery inspectors.

“Our new approach deploys a larger team of skilled professionals who conduct in-depth refinery inspections with the ultimate goal of preventing workplace accidents, explosions and other unplanned events that could affect workers and the surrounding community,” said PSM Statewide Manager and Policy Advisor Clyde Trombettas.

Cal/OSHA’s PSM Unit is responsible for inspecting refineries and chemical plants that handle large quantities of toxic and flammable materials. Health and safety standards enforced by the PSM Unit, including adequate employee training, are intended to prevent catastrophic explosions, fires, and releases of dangerous chemicals.

Cal/OSHA helps protect workers from health and safety hazards on the job in almost every workplace in California. Cal/OSHA’s Consultation Program provides free and voluntary assistance to employers and employee organizations to improve their health and safety programs. NEW YORK, April 13, 2015 /PRNewswire-HISPANIC PR WIRE/ — The Vilcek Foundation has selected the field of theatre as the awards category for the 2016 Vilcek Prizes for Creative Promise in the Arts. Three foreign-born theatre professionals will be chosen to receive the prizes, each comprising an unrestricted cash award of $50,000.

The Vilcek Prizes for Creative Promise honor young immigrants who have demonstrated exceptional creative achievements early in their careers.  Applicants must:

  • have been born abroad;
  • be naturalized citizens or permanent residents of the United States; also eligible are persons who have held a valid H-1B or O-1 visa for at least 5 years, and individuals who have been granted Deferred Action for Childhood Arrivals (DACA) relief;
  • be no more than 38 years old as of December 31, 2015;
  • intend to pursue a career in the United States.

Theatre professionals from a wide range of categories are invited to apply.  Eligible categories include playwright, director, actor, designer, composer, lyricist, and choreographer.  The deadline for the submission of applications is June 15, 2015.

The plaintiffs contend that Duke violated two federal statutes, the Robinson-Patman Act and the Racketeer Influenced and Corrupt Organizations Act, and a state statute, Ohio’s Pattern of Corrupt Activity Act.  The plaintiffs also assert common-law claims for fraud and civil conspiracy.  The defendants deny these allegations, assert that the agreements and the payments did not violate any law, and otherwise maintain that they did not engage in any wrongdoing. 

RIGHTS AND OBLIGATIONS OF CLASS MEMBERS

If you are a class member and do not opt out, you will automatically become a class member in this lawsuit and will be bound by any judgment or other final disposition, whether favorable to the class or not.  There is risk associated with any litigation and no guarantee that you will obtain any recovery.  As a class member, you would be represented by the named plaintiffs and by the attorneys representing the class.  You would not be charged for this representation.  If the class succeeds in the lawsuit, you would, upon meeting any prerequisites set by the Court, share in the distribution of any money damages recovered in this lawsuit.  If the class succeeds in the lawsuit, the attorneys representing the class will ask the Court to award them attorney’s fees based on a reasonable percentage of the total benefits conferred on the class.  You may enter an appearance through your own attorney by mailing a Notice of Appearance to the Clerk of the Court, 85 Marconi Blvd., Columbus, Ohio, 43215.  You should retain all records and documents pertaining to this matter, including all billing statements.  You should notify the attorneys representing the class of any change in your address or e-mail address, by sending an email to [email protected].

ELECTION BY CLASS MEMBER

If you want to be excluded from this class, you must send a written notice of your intent to exclude yourself from the class, with your full name, social security number, current mailing address, phone number, e-mail address, and a statement that you wish to be excluded by mail postmarked no later than June 1, 2015 to: Williams v. Duke Energy, P.O. Box 10092, Dublin, OH, 43017-6692.  If you send that notice, you will not share in any recovery in this case, will not be bound by any judgment and will retain any claims you may have against the defendants, subject to applicable statutes of limitations.
