A class action settlement has been reached concerning JCPenney’s (“JCPenney”) pricing practices. The lawsuit claims that JCPenney used false “regular” and “original” prices for its private and exclusive branded products. The lawsuit is known as Spann v. JCPenney Corporation, Inc., Case No. 12-cv-0215FMO, pending in the U.S. District Court for the Central District of California. JCPenney denies that it used false price comparison advertising or that it has done anything wrong, and denies that the Plaintiff or the class has been harmed in any way. The Court has not decided who is right.
Who is a class member?
You may be an eligible class member if you purchased any JCPenney private or exclusive branded clothing or accessories in California at a discount of least 30 percent off of a “regular” or “original” price between November 5, 2010 and January 31, 2012, or between January 1, 2013 and December 31, 2014.
What does the Settlement provide?
JCPenney has agreed to make available $50 million to settle the lawsuit. If you are eligible, you can choose either a cash payment or a store credit of equal value for use at any JCPenney store or on its website. The store credit will maintain a running balance, will not expire, and can be used to purchase any item(s) with or without discounts. You can give your store credit to someone else but it cannot be resold or exchanged for cash.
What do I need to do?
If you want to participate in the settlement, you must file a claim, by June 30, 2016 to receive either cash or a store credit. If the Court approves the settlement, you will give up your right to sue JCPenney for any of the claims released in the settlement. If you don’t want to participate, you may exclude yourself by June 30, 2016. You will not receive cash or a store credit, but you will keep your right to sue JCPenney on your own for the same claims in this matter. You may object and tell the court why you don’t like the settlement, but you must do so by June 30, 2016. If you do nothing, you will NOT receive money or a store credit, and you will be bound by the decisions of the Court.
The Court has appointed Class Counsel, who have requested attorneys’ fees of $13,500,000 (27 percent of the Settlement Fund), plus reimbursement of $191,080.91 in out-of-pocket expenses, and an Enhancement Award of $10,000 to the Representative Plaintiff. The Settlement Fund will also be used to pay up to $2,667,000 for the costs of a third-party notice and claim administrator. The remainder will be distributed to class members who submit valid claims. The motion for attorneys’ fees and costs is posted on www.JCPenneySettlement.com. The amount that you receive will depend on the number of claims submitted, the amount that you spent on qualifying purchases at JCPenney, and the amount of fees and costs awarded by the Court.
The Court will hold a hearing on August 25, 2016 at 10:00 a.m. to determine whether to approve the settlement and how much to award in attorneys’ fees and costs. The date of the hearing may change without further notice, so please check the Settlement Website for updates.

Eating Foods High in Vitamin C Cuts Risk of Cataract Progression by a Third
SAN FRANCISCO, March 23, 2016 /PRNewswire-HISPANIC PR WIRE/ — A diet rich in vitamin C could cut risk of cataract progression by a third, suggests a study being published online today in Ophthalmology, the journal of the American Academy of Ophthalmology. The research is also the first to show that diet and lifestyle may play a greater role than genetics in cataract development and severity.

Cataracts occur naturally with age and cloud the eye’s lens, turning it opaque. Despite the advent of modern cataract removal surgery, cataracts remain the leading cause of blindness globally.[1] Researchers at King’s College London looked at whether certain nutrients from food or supplements could help prevent cataract progression. They also tried to find out how much environmental factors such as diet mattered versus genetics.
The team examined data from more than 1,000 pairs of female twins from the United Kingdom. Participants answered a food questionnaire to track the intake of vitamin C and other nutrients, including vitamins A, B, D, E, copper, manganese and zinc. To measure the progression of cataracts, digital imaging was used to check the opacity of their lenses at around age 60. They performed a follow-up measurement on 324 pairs of the twins about 10 years later.
During the baseline measurement, diets rich in vitamin C were associated with a 20 percent risk reduction for cataract. After 10 years, researchers found that women who reported consuming more vitamin C-rich foods had a 33 percent risk reduction of cataract progression.
Genetic factors accounted for 35 percent of the difference in cataract progression. Environmental factors, such as diet, accounted for 65 percent. These results make the study the first to suggest that genetic factors may be less important in progression of cataract than previously thought.
How vitamin C inhibits cataract progression may have to do with its strength as an antioxidant. The fluid inside the eye is normally high in vitamin C, which helps prevents oxidation that clouds the lens. More vitamin C in the diet may increase the amount present in the fluid around the lens, providing extra protection. Researchers noted that the findings only pertain to consuming the nutrient through food and not vitamin supplements.
“The most important finding was that vitamin C intake from food seemed to protect against cataract progression,” said study author Christopher Hammond, M.D., FRCOphth, professor of ophthalmology at King’s College London. “While we cannot totally avoid developing cataracts, we may be able to delay their onset and keep them from worsening significantly by eating a diet rich in vitamin C.”

Acura Unveils NSX GT3 Racecar in New York
NEW YORK, March 23, 2016 /PRNewswire-HISPANIC PR WIRE/ — Acura took the wraps off a NSX GT3 racecar today at the 2016 New York International Auto Show, announcing its intention to campaign the twin-turbocharged NSX supercar in North America starting in 2017. The NSX is currently undergoing testing and slated for homologation as an FIA GT3 class racecar this fall.
The unveiled Acura NSX GT3 racecar featured custom bodywork and aero components including a large deck wing spoiler, underbody diffuser and enlarged hood vents for efficient engine cooling. The NSX GT3 will be powered by a 3.5-liter, 75-degree, twin turbocharged DOHC V-6 engine using the same design specifications as the engine in the production 2017 Acura NSX, including the block, heads, valvetrain, crankshaft, pistons and dry sump lubrication system. The engine will be paired with a 6-speed, sequential-shift racing gearbox, delivering power to the rear wheels.
The NSX GT3 will utilize the production NSX’s ultra-rigid and lightweight multi-material body with aluminum-intensive space frame, which will be produced by the Performance Manufacturing Center in Ohio, the exclusive manufacturing home for the new Acura NSX. Its twin turbocharged V-6 engine will also be manufactured in Ohio.
Initial development of the NSX GT3 was conducted by the company’s Japan race engineering arm with testing on race circuits in Europe and Japan. Additional development, testing and final homologation to FIA GT3 global racing specifications is currently being undertaken by the company’s North American race engineering group, Honda Performance Development (HPD), in Santa Clarita, California.

Showcasing the new face of Acura, the restyled 2017 MDX is highlighted by the bold and distinctive diamond pentagon grille, first seen on the Acura Precision Concept that debuted at the North American International Auto Show in January. The new Acura grille is integrated with a more sharply sculpted hood, front fascia and front fenders coupled with new LED fog lights and restyled Jewel Eye™ headlights, which enhance the MDX’s distinctive and sporting demeanor. A new chrome rocker panel design adds an element of contrast to the MDX’s profile, while a revised rear bumper, body colored skid garnish and the addition of twin tailpipes further emphasizes the performance character of the 2017 Acura MDX.

All 2017 MDX models benefit from increased standard luxury and technology features, including an Electric Parking Brake with Automatic Brake Hold, Auto High Beam headlights, SiriusXM Radio® 2.0 and four 2.5-amp USB charging ports. Technology and Advance packages add Bi-Directional Keyless Remote Engine Start, two new 20-inch wheel and tire options, power folding side mirrors, and HD Traffic. In addition to these features, Advance grades add LED fog lights, genuine Olive Ash Burl or Black Limba wood interior trim, a heated steering wheel and Surround-View Camera System with six selectable viewing angles. Advance models can also be equipped with two second-row captain’s chairs and a center console with two additional USB ports, replacing the three-person second-row seating found on lower grades. An ultra-widescreen Rear Entertainment System is also available on models with the Advance ENT Package.
MDX Sport Hybrid
The 2017 MDX Sport Hybrid is the third model to feature Acura’s innovative three-motor Sport Hybrid SH-AWD powertrain, joining the Acura NSX supercar and RLX flagship sedan to deliver the ultimate in power and control. The 2017 MDX Sport Hybrid is powered by a 3.0-liter DOHC V-6 engine with Variable Cylinder Management™ (VCM™) mated to a 7-speed dual clutch transmission (7DCT) with an integrated electric motor powering the front wheels, and a Twin Motor Unit with two electric motors providing power to the rear wheels. Additionally, the system delivers electrified torque vectoring for improved straight line performance and cornering precision in combination with all-wheel-drive power application. Peak powertrain output of 325 horsepower is up 35 horsepower over the non-hybrid model. The MDX Sport Hybrid is anticipated to receive EPA fuel economy ratings of 25/26/26 (city/highway/combined), an estimated 7-mpg city fuel economy rating increase over the (non-hybrid) MDX with SH-AWD.
The 2017 MDX Sport Hybrid will be available with Technology and Advance packages. Both add a new Active Sport Suspension that delivers improved ride quality, handling performance and is integrated with the Integrated Dynamics System featuring the dynamic modes of Comfort, Normal and Sport, and exclusive to Sport Hybrid models, a new Sport+ mode.
AcuraWatch™ Standard
All 2017 MDX models receive the AcuraWatch suite of advanced safety and driver-assistive technology as standard equipment, including Collision Mitigation Braking System™ (CMBS™) with automatic emergency braking, Lane Departure Warning (LDW), Forward Collision Warning (FCW), Lane Keeping Assist (LKAS), Adaptive Cruise Control (ACC) with Low-Speed Follow (LSF) and Road Departure Mitigation (RDM). AcuraWatch uses a millimeter wave radar and monocular camera sensing technology to detect other vehicles as well as lane markings and can help intervene to prevent or mitigate the severity of a collision. Moreover, with Adaptive Cruise Control with Low-Speed Follow and Lane Keeping Assist, AcuraWatch can significantly decrease the driver’s workload during freeway cruising by maintaining a set speed and following interval, initiating both braking and throttle inputs, and adding steering input to help the driver maintain their position in the detected lane.
