Acura Team Penske Repeats at Mid-Ohio

Dane Cameron and Juan Pablo Montoya took their Team Penske Acura ARX-05 to victory today at the Acura Sports Car Challenge at Mid-Ohio.

LEXINGTON, Ohio, May 5, 2019 /PRNewswire-HISPANIC PR WIRE/ — Acura Team Penske remains undefeated at the Mid-Ohio Sports Car Course, successfully defending its inaugural IMSA WeatherTech SportsCar Championship win from 2018 as Dane Cameron and Juan Pablo Montoya combined to win Sunday’s Acura Sports Car Challenge.

Dane Cameron and Juan Pablo Montoya took their Team Penske Acura ARX-05 to victory today at the Acura Sports Car Challenge at Mid-Ohio.

In GTD, the Meyer Shank Racing pairing of Trent Hindman and Mario Farnbacher contended for the class win in their Acura NSX GT3 Evo throughout the two hour, 40-minute contest, and took over the Drivers’ Championship points lead with a second-place finish.

After two days of rain and unseasonably cool temperatures, the sun finally came out on race day as a 36-car field took the green flag at Mid-Ohio.  While front-row starter Helio Castroneves fell victim to contact with a pair of prototypes on the opening lap, damaging the bodywork of his #7 Acura ARX-05, teammate Dane Cameron took his #6 Acura up to second.

After shadowing early race leader Oliver Jarvis for the first 10 minutes, Cameron took the lead with a clean pass into the first turn, and continued at the front of the field until handing the driving duties over to Juan Pablo Montoya during the first round of pit stops.  Montoya fell back behind Jarvis during his opening stint, but regained the advantage as the race reached its midpoint.  Montoya then controlled the second half of the contest, taking the checkers by a margin of 2.02 seconds.

Castroneves ran the remainder of his driving stint with a damaged nose and right side bodywork before handing off to Ricky Taylor at his first pit stop.  The Acura Team Penske crew quickly fitted a fresh nose section, and Taylor persevered to a fifth-place finish.

Today’s win moves Acura within four points of Cadillac in the DPi Manufacturers’ Championship after four of 10 races.  Castroneves and Taylor remain second in the Drivers’ Championship, also four points out of first, with Montoya and Cameron unofficially ranked fourth.

In GTD, Mario Farnbacher and Trent Hindman took over the class championship points lead with a second-place finish today in their #86 Meyer Shank Racing Acura NSX GT3 Evo.  Starting driver Hindman led early, as did Farnbacher during the middle portion of the contest.  A charging Jack Hawksworth passed Farnbacher in the final 20 minutes and, while Farnbacher continued to challenge for the class win to the finish, he fell just over a half-second short at the finish.

Teammate Christina Nielsen also had a strong start in the #57 Acura NSX, moving into fourth place in the opening laps and surviving contact from a competitor that resulted in right-side damage.  Taking over the car in fifth place, co-driver Katherine Legge continued to run in the lead group, despite a brief off-course excursion in the second hour.  Late in the race, the Acura stalled on course, and Legge lost a lap and fell to 12th in class while re-firing the NSX.  She was able to regain two positions in the closing 30 minutes, and finished 10th in GTD.

The Motor City of Detroit is the next stop in the 2019 WeatherTech SportsCar Championship, for the Detroit Grand Prix Presented by Lear.  The 100-minute contest, one of two “sprint races” on the IMSA calendar, takes place June 1 on the tight and bumpy Belle Isle Park temporary street circuit, with live television coverage on the NBC Sports network.

These National Honorees, named during the program’s 24th annual national award ceremony at Union Station’s East Hall, range in age from 11 to 17. They were selected first from a field of more than 29,000 middle level and high school youth volunteers nationwide, and then from 102 State Honorees, based on their initiative, effort, impact, and the personal growth demonstrated in the course of their volunteer service. The National Honorees each received $5,000 personal awards, engraved gold medallions, crystal trophies for their schools, and $5,000 grants from The Prudential Foundation for charities of their choice. 

Today’s ceremony was part of a four-day celebration that brought each state’s top two youth volunteers of 2019 to Washington, D.C., for sightseeing and special recognition events. These State Honorees – one middle level and one high school student from each state and the District of Columbia – were personally congratulated by award-winning actress Viola Davis last night at a gala dinner reception at the Smithsonian’s National Museum of Natural History. Each State Honoree received a $1,000 award.

These are the 10 National Honorees named today:
Grace Beal, 17, of New Castle, Pennsylvania, a junior at Neshannock Senior High School, organized an annual basketball-based fundraising event that has raised more than $100,000 since 2014 for Children’s Hospital of Pittsburgh, where her sister was treated before she died of congenital heart failure.

Aja Capel, 15, of Urbana, Illinois, a member of Champaign County 4-H and a junior at Urbana High School, serves as the lead robotics instructor at a local science museum and has launched an initiative to give minority students more opportunities to learn about science, technology, engineering and math (STEM).

Alexander Fultz, 13, of Pineville, North Carolina, an eighth-grader at Metrolina Regional Scholars Academy, created a nonprofit organization that has donated thousands of toys and clothing items to hospitals in several states to brighten the days of hospitalized patients.

Samaia A. Goodrich, 11, of Syracuse, New York, a sixth-grader at Expeditionary Learning Middle School, organizes projects in her community to encourage inner-city youth to make a difference, including an effort to raise money to buy Christmas presents, clothes and household goods for families who moved from Puerto Rico to Syracuse after Hurricane Maria devastated their homeland.

Hannah Karanick, 13, of Anaheim, California, an eighth-grader at Orangeview Junior High School, established a “closet” at her former elementary school that provides new clothing, laundry products, toiletries, quilts and school supplies to students there whose families can’t afford to buy such necessities.

Caleb Oh, 14, of Gambrills, Maryland, an eighth-grader at Crofton Middle School, has spent more than 1,000 hours volunteering in many ways over the past seven years to aid people who are homeless, hungry or have other needs.

Caragan Olles, 16, of De Pere, Wisconsin, a junior at Notre Dame Academy, co-founded a nonprofit organization in 2013 that has raised more than $160,000 to provide special tutoring for students with dyslexia, create dyslexia resource centers in three public library systems, and educate teachers and parents about this learning disability. 

Vance Tomasi, 13, of Tampa, Florida, a seventh-grader at Farnell Middle School, has worked with a friend to collect and donate more than 90,000 books to families, schools, group homes, hospitals and libraries over the past two years.

Allison Tu, 17, of Louisville, Kentucky, a senior at duPont Manual High School, launched a youth-driven initiative to raise awareness of student mental health issues and find ways to combat the alarmingly high rates of depression, anxiety and suicide among young people in Kentucky.

Joseph Voynik, 17, of Flowood, Mississippi, a senior at Jackson Preparatory School, worked for four years and raised more than $600,000 to construct a fully accessible baseball field so that children with disabilities could experience the joy of playing America’s national pastime.

California SB 58 Opponents Hold Los Angeles Press Event

LOS ANGELES, May 4, 2019 /PRNewswire-HISPANIC PR WIRE/ — California Alcohol Policy Alliance (CAPA), Alcohol Justice, and Los Angeles City Councilmember Paul Koretz hosted a press event at Los Angeles City Hall yesterday to oppose SB 58, the third attempt by Senator Scott Wiener (D-San Francisco) to impose an irresponsible 4 a.m. bar closing time “pilot project” on California.  Speakers representing groups and organizations throughout the state reported on the city and statewide public health and safety threats the bill would create by allowing a patchwork quilt of ten cities – including Los Angeles – to extend alcohol sales at bars, restaurants, and clubs to 4 a.m.

“Ever since Senator Wiener introduced his first of two failed attempts at a 4 a.m. bar bill in 2017, I have been saying that no one should ever prioritize a few hours of extra bar profits over public health and safety,” stated Los Angeles City Councilmember Paul Koretz. “The Senator is well-aware this bill will only benefit a small number of bar and nightclub owners. What he fails to acknowledge is that those minimal gains for his nightlife supporters will cost governments and taxpayers dearly for law enforcement and emergency medical services. If this bill should pass, there will be additional DUI-related deaths and injuries. As an elected official, our first priority should be to protect the lives of our constituents, so I call upon my colleagues in the State Legislature to do just that and vote NO on SB 58.”

Council Member Koretz introduced a resolution (Council File: 19-002-S39) opposing SB 58 on March 5, 2019. There is growing support among the other L.A. City Council Members and a vote could come in June. In Sacramento, SB 58 is currently sitting in the “Suspense File” of the California Senate Appropriations Committee where a determination on the bill is expected by May 16, 2019. If passed, it would then face a Senate floor vote by May 31, 2019, before crossing over to the Assembly to continue the legislative process. 

In 2017, Senator Wiener introduced SB 384, his first dangerous piece of legislation intending to strip away the protections of the state’s uniform, normal 2 a.m. closing time. It was turned into a study bill in the Assembly Committee on Appropriations and then gutted by the author and changed to a different topic.

In 2018, Senator Wiener introduced SB 905, which would have allowed nine cities to participate in a half-baked, so-called, “pilot project” to extend sales from 2 a.m. to 4 a.m. The legislature ignored the overwhelming evidence that 76% of the state’s population would be turned into unwitting “Splash Zone” lab rats suffering increased public health and safety harms. They passed the bill, but Governor Brown, heeding the advice of the CHP, wisely vetoed the bill with these words: “I believe we have enough mischief from midnight to 2 without adding two more hours of mayhem.”

Wiener’s SB 58, which is virtually identical to last year’s SB 905, continues to mock the scientific process of a true pilot project, as well as the proven public health and safety concerns of extending alcohol-trading hours in ten cities, Los Angeles, San Francisco, Sacramento, Oakland, Long Beach, West Hollywood, Palm Springs, Cathedral City, Coachella, and Fresno, as well as the Splash Zones surrounding them, will now be spared additional alcohol-fueled harm.

“SB 58’s author Senator Wiener claims that night life is critical to culture and economy. This belittles the great potential and abilities that exist in our communities apart from substance consumption,” stated Gennesis Lopez, Co-Chair of the Coalition to Prevent Alcohol-Related Harms in LA Metro (COPALM). “My concern with this bill is that low-income and underserved communities will be impacted the most. Families who are on constant survival mode and have limited literacy or luxury of time become targets for the expansion of nightlife. Nightlife is not meant or geared at “responsible decisions” and it perpetuates judgment impairment, human trafficking, and sex exploitation among many other issues. As a mother, I know that that is not the type of community I wish my children to be raised in. Today I stand in opposition of the 4 a.m. bill, not just for myself, but also for those who do not have a voice due to their immigration status, age, language barrier or any other hindrance. At the core of the protest was the concern that if passed by the legislature SB 58 would probably be signed into law by Governor Newsom, whose alcohol-related businesses have made him a very wealthy man. The bill would then launch a dangerous five-year experiment that could expose over 76% of California’s population to increased alcohol-related harm.

“MADD is extremely concerned that eliminating a statewide cutoff limit on the sale of alcohol will encourage “barhopping” – patrons driving from one city to the next looking for one last drink,” Melissa Estelle, MPH, CHES, Senior Program Specialist, Legislative Liaison for Mothers Against Drunk Driving (MADD) Southern California. “On behalf of the victims and survivors we serve, MADD urges lawmakers to reject SB 58 in its current form. Please consider not only the fiscal impact DUIs have on our communities, but also the lifelong consequences caused by one person’s choice to drink, and then drive.”

California currently suffers over 10,500 alcohol-related deaths and $37+ billion in costs annually. The California Office of Traffic Safety (OTS) has reported that fatal DUI is a chronic, worsening problem for the state. Between 2014 and 2016, alcohol-related crash deaths rose 21%. That number can only go up with two additional hours of alcohol consumption. Thus, the only benefit of selling alcohol between 2 and 4 a.m. will be greater profits to bar, restaurant, and club owners in the party zones the bill will create; while the public and all levels of government will be forced to continue to cover the costs of mitigating the harms that follow.

“We hope Senator Wiener and the rest of our state legislators hear us loudly, again, that CALIFORNIA COMMUNITIES DO NOT WANT A 4 A.M. LAST CALL,” stated Brenda Villanueva, Co-Chair of the Los Angeles Alcohol and Drug Policy Alliance (CAPA). “All the peer-reviewed science says that increases in hours of sale that are two hours or greater will lead to increases in excessive alcohol use and related problems. We are asking all of our legislators: Por favor, take a stand for public health over private profits and KILL THIS BILL.”

The data most often referred to and consistently ignored or dismissed by Senator Wiener & his late night supporters comes from a U.S. Centers for Disease Control (CDC) task force led by Jonathan Fielding, M.D., M.P.H., M.A., M.B.A, Distinguished Professor UCLA Fielding School of Public Health and UCLA Geffen School of Medicine. The U.S. Community Preventive Services Task Force found in a peer-reviewed, global meta-analysis that every 2-hour increase in last-call times results in greater vehicle crash injuries and E.R. admissions. (Hahn et al., 2010) Dr. Fielding stated, “…I have no reason to believe that an increase in hours of sale anywhere in the U.S. would have different results.”

“I’ve been working on this project since 2014 when it started as No More Liquor Stores,” said Miriam Castro, Promotora and activist with Madres Que Luchan. “It’s unfortunate that on every street there are places exposing our children, grandchildren and senior citizens to alcohol. We know it would be more negative to allow for a 4 a.m. last call. The community calls on our decision makers to take action. We are not invisible!”

The peer-reviewed evidence for increased harms has been presented to the legislature and the Governor in a joint CAPA/Alcohol Justice report entitled, The Late Night Threat, Science, Harms, and Costs of Extending Bar Service Hours. It highlights the existing data supporting how the acute effects of extending alcohol sales would spread to “Splash Zones” surrounding the ten cities in Wiener’s poorly constructed “pilot project.”

“SB 58 fails to address who will pay for the alcohol-related harms that this bill will cost,” said Veronica De Lara, co-chair of the California Alcohol Policy Alliance. “The bill will endanger all the lives of the commuters that will be going to work in the early hours.”

SB 58 will spread alcohol overconsumption, loss of life, injury, and nuisance across the state. We cannot allow that to happen.”

Southern California Gas Company natural gas customers may be affected by a class action settlement

LOS ANGELES, May 3, 2019 /PRNewswire-HISPANIC PR WIRE/ — Ahdoot & Wolfson, PC and the Law Offices of Paul G. Kerkorian announce that a settlement has been reached with the City of Los Angeles (the “City” or “Defendant”) in a class action lawsuit claiming City improperly included in its natural gas utility user tax calculation charges known as the Public Purpose Surcharge (“PPS”) and the State Regulatory Fee (“SRF”). The lawsuit contends that the City may only calculate the Los Angeles City Users Tax on the amount of natural gas used, and not on the PPS and SRF. The City denies the allegations, and the Court did not issue a final decision in favor of either Plaintiffs or Defendant. Instead, the parties agreed to a settlement to avoid the expense and risk of continued litigation.

You are a “Class Member” if you are a Southern California Gas Company (“SCGC”) natural gas customer who was charged the City of Los Angeles’ natural gas utility user tax (described on the SCGC natural gas bill as the line item “Los Angeles City Users Tax”) with a billing period that includes at least one day that falls on or after December 12, 2012 through April 12, 2019.

As part of the Settlement, the City has agreed to stop imposing the Los Angeles City Users Tax on the PPS and the SRF, unless such a tax is approved by voters in the future, if ever. This change will result in estimated $6.18 million of tax savings per year. The City has also agreed to create a $32,500,000 Settlement Fund, that, after deducting settlement administrative expenses, court-approved service payments, a payment to a non-profit charitable organization known as the Alliance for Children’s Rights, and court-approved attorneys’ fees and expenses, will be distributed by applying a tax abatement (i.e., a reduced Los Angeles City Users Tax rate for SCGC customers who are subject to the Los Angeles Users Tax).

If you are included in the Settlement, you may choose to do nothing, or object to the Settlement and notify the Court that you or your lawyer intend to appear at the Court’s Final Fairness Hearing, or exclude yourself from the Settlement.

The Court will hold a hearing in this case (Lavinsky v. City of Los Angeles, et al., Case No. BC542245) at 10:00 a.m. on October 9, 2019 at Department 11 of the Superior Court of California, County of Los Angeles, 312 North Spring Street, Los Angeles, California, 90012.
